Changes in migration law 2023: EU, Poland and Australia change residence rules for foreigners

Global migration law is very dynamic. Every day in different countries of the world, the leadership works on improving their own migration legislation: they approve new rules for crossing borders, change the procedure for issuing a permit for legal residence, rework the necessary package of documents, etc. Sometimes it is difficult to cover all the innovations that are taking place in the world migration policy.

European Union
"Single Permit"
The European Union continues to work on updating the procedure for obtaining a "single permit" - a document that gives the right to legally live and work in the EU to foreigners who are citizens of countries that are not part of the European Union.
In particular, on June 8, 2023, the Council of the EU agreed on its position on the renewal of the EU law concerning legal migration to the EU labor market. The updated rules simplify the application procedure and make it more efficient. Workers from third countries will have more rights and be more protected. Thanks to the "unified permit", the EU leadership plans to reduce the shortage of personnel in the region.
Based on the approved common position, the Council will be able to start negotiations with the European Parliament to agree on the final text of the document.
Strengthening the asylum procedure
After years of disputes, the EU has agreed to reform the asylum system. Its main goal is to reduce the flow of people without the right to protection.
The asylum procedure in the EU will be significantly strengthened. In particular, the changes provide for a much stricter border crossing procedure for migrants. In the future, people arriving from countries considered safe will have to undergo a control procedure at the reception point after crossing the border: within twelve weeks, the relevant services will check whether the applicant has a chance of receiving asylum. If not, he is immediately deported back.
During the negotiations, representatives of the German government strongly advocated that families with children be exempted from the so-called border procedures. Federal Minister of the Interior Nancy Feser said that the federal government will continue to work to ensure that children's rights are protected.
Poland
From June 24, 2023, changes to the rules governing the issuance of residence permits for long-term residents of the European Union will enter into force. From now on, one of the requirements for issuing a permit will be a foreigner's confirmed knowledge of the Polish language at the B1 level. A foreigner can confirm his knowledge of the Polish language with the help of appropriate certificates.
Australia
There will be many changes in Australia's migration policy in June:
Temporary relaxation of work rights for international students ends - international students in Australia generally have limited work rights. However, to help Australian businesses recover from the COVID-19 pandemic, the Australian government has introduced temporary relaxation of work rights for student visa holders. This temporary relief will expire on July 1, 2023. Only international students working in the aged care sector will be able to continue working without restrictions, this right will remain until 31 December 2023.
New Zealand citizens will be eligible for Australian citizenship - From 1 July 2023, New Zealand citizens who have lived in Australia for more than four years and arrived in Australia after 26 February 2011 will be eligible to apply for Australian citizenship without having to apply for a permanent visa. These changes only apply to New Zealand citizens who hold a Special Category (Subclass 444) (SCV) visa.
Increase in the fee for visa processing - from July 1, 2023, the fee for processing a visa will increase by an amount from 6 to 40%. The increase will affect the following types of visas:
- guest visa, work visa, study and temporary work permit - by 15%;
- investment visas – 40%;
- other visas – 6%;
- Pacific Engagement Visa and Pacific Australia Labor Mobility Visa – Exempted from promotion.
